TORONTO RAPTORS FORD EDGE (the “Contest”)

RULES & REGULATIONS

(“Contest Rules”)

 

Participation in the Contest constitutes full and unconditional agreement and acceptance of these Contest Rules, which are final on all matters relating to the Contest.

 

1.         Eligibility:  No Purchase Necessary.   This Contest is open only to legal residents of Ontario 19 years of age and older who live within a 75 mile radius of the City of Toronto and hold a valid drivers license.  Employees (and their immediate families and those with whom they are domiciled) of Maple Leaf Sports & Entertainment Ltd. (“MLSE”), Ford Motor Company of Canada, Limited, Ford/Lincoln Dealers (collectively, the “Contest Sponsors”) and the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective subsidiaries, affiliates, directors, officers, governors partners, representatives, agents, their advertising and promotional agencies are not eligible to enter.  Immediate family includes the parents, husband, wife, son, daughter, brother, sister, mother, or father of an individual.

 

 

2.         How To Enter:  The Contest begins at 5:00 pm EST on January 26, 2007 and closes at 12:01am EST on October 26th 2007 ( the “Contest Closing Date”). There are three (3) ways to enter. LIMIT one (1) entry per person regardless of entry method.

 

(a)   Method #1:  On-Line: Visit www.raptors.com, follow the contest link and fully complete and submit the online entry form.

 

(b)   Method #2:  SMS Text Messaging:              Text to short code 22255 to enter.  To enter via SMS Text Messaging, you must have a mobile telephone that has a two-way text messaging capable handset and digital service feature. Text messaging is not available in all areas. You will be charged standard text messaging service charges.  Check your carrier plan for your standard text messaging fees. 

 

(c)           Method #3:   2007/08 Toronto Raptors Season Seat Holders: All 2007/08 Toronto Raptors Season Seat Holders of record as of the Contest Closing Date will automatically be entered. The identity of the Season Seat Holder of record will be determined by MLSE in its sole discretion.  MLSE’s decisions and determinations in all cases will be final and binding. 

 

Regardless of entry method, in order to be eligible to win a prize, entries must be received prior to the Contest Closing Date.  Entrants are only eligible to qualify as a secondary prize winner via one method of entry.

 

 

3.                  Prizes:   The following prizes are available to be won:

 

(a) Twenty (20) Secondary Prizes each consisting of two (2) gondola tickets to the Raptors 2007/08 regular season home opener at the Air Canada Centre, plus the opportunity to participate in the Grand Prize Draw and competition (approximate retail value $360 CDN). 

 

      All incidental costs and expenses not specifically identified as being included  (including, without limitation,  taxes, transportation to and from Air Canada Centre, food, beverages, souvenirs, personal expenses) shall be the sole responsibility of the winners. 

 

 

(b)  One (1) Grand Prize consisting of:  one (1) 2007 Ford Edge, customized according to fan preferences as indicated by voting that takes place on www.raptors.com, including 3.0L Duratec V6 engine, 6-speed automatic transmission, power vented 4-wheel disc brakes, (additional vehicle upgrades to be determined based on voting results: Vehicle upgrades to be voted on include the exterior, interior, audio system, and wheels and rims). (approximate retail value: $80,000.00 which includes freight, pre-delivery inspection charges and taxes).

 

The winner of the Grand Prize must take delivery of the Grand Prize from an Ontario Ford Canada dealership close to his/her residence designated by Ford Motor Company of Canada, Limited.  The winner is responsible for all taxes and expenses which are not included in the Grand Prize description above, including but not limited to: licensing, insurance, registration, gas, gas consumption tax, and all other costs incurred in claiming, registering or using the Grand Prize vehicle. Ford Motor Company of Canada Limited reserves the right, at its sole discretion, to substitute the Grand Prize with another vehicle of equivalent or greater value or of a different model year for any reason including, but not limited to: production delays caused by labour disruptions, part shortages, adverse weather conditions or other unforeseen events, or any other reasons.  Once the winner has been notified that the Grand Prize vehicle is at winner’s local Ford dealership for delivery, he/she must take possession of the vehicle within four (4) weeks of such notice or the Grand Prize vehicle will be forfeited and there will be no liability of Ford Motor Company of Canada in the event this occurs.  A Grand Prize winner’s refusal or inability to accept the Grand Prize awarded shall release Contest sponsors from all obligations. 

 

To claim the Grand Prize, the winner must be an Ontario resident, must hold a valid Ontario driver’s licence and must have satisfactory proof of insurance.

 

Grand Prize vehicle may not be exactly as shown in contest publicity or promotional materials. 

           

 

4.         Draw/Winner Selection:      

 

(a)   Secondary Prize Draw:  A total of twenty (20) random draws will be conducted on or about October 26th, 2007 at the offices of MLSE, to determine the twenty (20) secondary prize winners as follow: twelve (12) from all entries received by Method #1; five (5) from all entries received by Method #2; and three (3) from all entries received by Method #3. Entrants are only eligible to win one (1) Secondary Prize.  Only one secondary prize will be awarded per person.  All secondary prizes will be available for pick-up at the Air Canada Centre Box Office located at 40 Bay Street, Toronto, Ontario, M5J 2X2 in the Galleria.

*           Any 2007/08 Raptors Season Seat Holder that is a legal entity other than an individual that is randomly selected to win a Secondary Prize will be required to nominate (in the form provided by MLSE) an individual representative to attend at the Gondola for the 2007/08 Toronto Raptors regular season home opener on the Season Seat Holder’s behalf and to, if necessary, compete in the Grand Prize competition on behalf of such Season Seat Holder.

 

Odds of winning a Secondary Prize depend on number of eligible entries received by the Contest Closing Date.

 

(b) Grand Prize Competition:   In order to be eligible to compete in the Grand Prize competition, confirmed Secondary Prize winners must attend the 2007/08 Raptors regular season home opener at the Air Canada Centre and must be seated in the Gondola prior to the game tip-off.  Participation in the Grand Prize competition is non-transferable.  During the Raptors regular season home opener for the 2007/08 season, three (3) Secondary Prize winners who are in the Gondola and the time of the draw will be randomly chosen to compete in the Grand Prize competition.  The  three (3)  randomly selected qualifiers will compete against each other on-court at Air Canada Centre for the Grand Prize.  Only one on-court competitor will win the Grand Prize.  Only selected secondary prize winners can compete on-court, their guests are not eligible to compete in their place.  All elements of the on-court competition will be determined by MLSE, in its sole discretion.  

 

The odds of being selected to compete for the Grand Prize among all Secondary Prize winners are 3 in 20.  The odds of winning the Grand Prize among all Grand Prize competitors are 1 in 3 and depends on the respective skill of the competitors.

 

Before being declared a Secondary Prize winner or a Grand Prize winner, all selected entrants must: (i)  correctly answer a time-limited mathematical skill-testing question without assistance or the use of a calculator, administered at the time of contact; and (ii)   sign a Declaration of Compliance with the Contest rules and a Release of Liability, releasing the Contest Sponsors and the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective subsidiaries, affiliates, directors, officers, governors, agents (collectively, the “Released Parties”) from any and all liability in connection with: (i) entrant’s participation in the Contest; (ii) the acceptance and use of any prizes awarded in the Contest; and (iii) the administration of the Contest by the Contest Sponsors, including (without limitation) the selection of prize winners or the distribution of prizes awarded in this Contest. The Declaration and Release document must be returned on or before the date indicated on the documents or the prize will be forfeited.  In addition, before competing in the Grand Prize competition, selected Grand Prize competitors must sign such release of liability forms as provided by MLSE.

 

In the case of 2007/08 Toronto Raptors Season Seat Holders, prizes will be awarded to the Season Seat Holder of record with MLSE only and may not be transferred to or redeemed by any other party.  In cases where the Season Seat Holder of record is a corporation or legal entity other than an individual, the Grand Prize will only be released to a party who has the legal authority to bind the corporation or such other legal entity.

 

If a selected entrant cannot answer, or incorrectly answers, the skill-testing question, or, in the case of an eligible Secondary Prize fails to respond to the notification within twenty-four (24) hours of the first attempted contact, or if MLSE is otherwise unable to contact the selected entrant within such time, or if a selected entrant otherwise does not meet any of the Contest eligibility requirements, or satisfy any other Contest conditions, that entry will be disqualified and another entry will be selected.  The process will continue until all twenty (20) Contest finalists have been selected.

 

5.         General Rules          

Each prize must be accepted as awarded and no prize substitutions of cash or otherwise or transfer of the prize will be made, provided that the Contest Sponsors may make prize substitutions of equal or greater value.  Prizes may not be exactly as shown in contest publicity or promotional materials.

By entering this Contest, each entrant consents to the use of his/her name, image, photograph, voice statement(s) and city of residence, without further compensation, for any and all publicity purposes, commercial or otherwise, in all media used by the Contest Sponsors, the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective subsidiaries, affiliates, directors, officers, governors, agents, their advertising and promotional agencies.

The Contest is subject to all applicable federal, provincial and municipal laws and regulations and shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

By entering the Contest, each entrant agrees to be bound by these rules and regulations and all decisions of the Contest Sponsors, which decisions are final with respect to all matters relating to the Contest, including (without limitation) the selection of  Prize winners and Grand Prize winner.  All decisions will be made by the Contest Sponsors with respect to any aspect of this Contest are final.

By entering the Contest, entrants agree to hold harmless and indemnify the Released Parties, the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective subsidiaries, affiliates, directors, officers, governors, agents, their advertising and promotional agencies against any and all liability, damages or causes of action (however named or described with respect to or arising out of either: (i) entrant’s participation in the Contest; (ii) the receipt or use of the prizes awarded herein; or (iii) the administration of the Contest (including winner selection) and distribution of the prizes awarded herein.

Entrants hereby release, waive and discharge any and all claims of damage, loss or causes of action (including, negligence), including (but not limited to) death, personal injury or loss or damage to property, which the entrant or any of the entrant’s representatives, heirs, next of kin or assignees (“Entrant’s Representatives”) may have or which may hereinafter accrue to the entrant or Entrant Representatives against the Released Parties as a result of the entrant’s participation in the Contest or the receipt or use of the Prize(s) awarded herein.

The following are prohibited and will result in automatic disqualification from the Contest: (1) using any method that artificially increases odds of winning; (2) non-compliance with these Contest Rules; and (3) any other act which the Contest Sponsors determine, at their sole discretion, jeopardizes the integrity of the contest.

The Contest Sponsors are not responsible for any printing, distribution or production errors, mobile phone failures, text messaging errors or failures and any late, lost or misdirected entries.  The Contest Sponsors may terminate, modify, suspend or withdraw from this Contest (and/or any aspect thereof, including methods for selection of the prize winners), in whole or in part, at any time without notice for any reason, without liability, at their sole discretion. In no event shall Contest Sponsor be held to award more prizes than what is mentioned in these Rules or to award prizes otherwise than in compliance with these rules.

The Contest Sponsors shall not be responsible for tampering, theft, human errors (including gross negligence) ineligibility, lost, late or misdirected entries or for any problems, failures or technical malfunctions of any telephone network or lines, computer online systems or servers, computer software problems or traffic congestion on the internet, or at any website and assume no liability for damage to entrant’s or any person’s computer or mobile phone resulting from participating in the Contest. In the event of a dispute as to the identity of a selected entrant based on a mobile phone number or e-mail address, the selected entry will be deemed to be made by the authorized account holder of the mobile phone number or e-mail address (determined by reverse domain name search) at the time of entry. “Authorized account holder” is the natural person who is assigned a mobile telephone number/e-mail address by a wireless provider/internet service provider, telecommunications carrier or other organization responsible for assigning the submitted mobile telephone number/e-mail address. Selected entrants may be required to provide the Contest Sponsors with proof that he/she is the Authorized Account Holder of the mobile telephone number/e-mail address associated with the selected entry.
